Why the DOJ is facing an uphill battle to prove price-fixing. By Shaylin Clark · April 23, 2012

The U.S. Justice Department had sued Apple and five major publishing houses. The suit alleges that ahead of the 2010 launch of the original iPad (and iBooks) Apple colluded with Macmillan, Penguin, Hachette, HarperCollins, and Simon & Schuster to raise e-book prices by adopting a agency model for pricing.

Before the iPad launched in 2010, Amazon effectively owned the e-book market with its Kindle e-reader. Operating on a wholesale model for pricing, Amazon paid a wholesale price for e-books, then set its own prices for them. Much to the publishers’ frustration, Amazon used books in a way no retailer had done before: as a loss leader. It sold the e-books below wholesale in order to drive sales of the Kindle. Publishers feared that this would create unreasonable expectations among customers, and that it would drive down the cost of hard copy books – especially hardcovers, which are the publishers’ biggest money makers.

While Barnes & Noble tried to elbow its way into the e-book market with its Nook e-reader (which was arguably superior to the Kindle in terms of hardware), it met with little real success, never getting closer than a distant second to the Kindle. When Apple launched the iPad and its iBooks e-reader software, though, it also announced new deals with the five publishers named in the Justice Department’s lawsuit. Under the agency model, it’s the publishers who set the prices of e-books, and the retailer – in this case Apple – gets a 30% cut off the top for every book sold. Once the iPad took off in popularity – to the point that it harmed sales of e-readers like the Kindle and Nook – the publishers were able to force Amazon and Barnes & Noble to enter into the same sort of agency model agreements they had with Apple.

All of this raised major concerns with the Justice Department (and the European Commission), which thought the switch to the agency model smacked of anti-competitive collusion. They finally filed an antitrust suit against all six companies earlier this month. While three of the companies – Hachette, HarperCollins, and Simon & Schuster – reached quick settlements to avoid a costly legal battle, the other three did not. Macmillan, Penguin, and Apple all issued statements insisting they had done nothing wrong. What’s more, they claimed that although the agency model did result in higher e-book prices, it actually fostered competition by breaking Amazon’s stranglehold on the e-book market….

“WASHINGTON (AP) — The government says avid best-seller readers who use electronic books have been getting ripped off. Tina Fey’s “Bossy Pants,” Tim Tebow’s “Through My Eyes” and Keith Richards’ “‘Life” — maybe they should have cost less.

The Justice Department and 15 states sued Apple Inc. and major book publishers Wednesday, alleging a conspiracy that raised the price of electronic books. They said the scheme cost consumers more than $100 million in the past two years by adding $2 or $3, sometimes as much as $5, to the price of each e-book.

If there was price fixing, even the e-book version of the hot-selling Walter Isaacson biography of Steve Jobs, the late genius behind Apple computers, may have cost too much.

Attorney General Eric Holder said executives at the highest levels of the companies conspired to eliminate competition among e-book sellers. Justice’s antitrust chief, Sharis Pozen, said the executives were desperate to get Amazon.com — the marketer of Kindle e-book readers — to raise the $9.99 price point it had set for the most popular e-book titles, because that was substantially below their hardcover prices.

The federal government reached a settlement with three of the publishers, Hachette, HarperCollins and Simon & Shuster. But it will proceed with its lawsuit in federal court in New York City against Apple and Holtzbrinck Publishers, doing business as Macmillan, and The Penguin Publishing Co. Ltd., doing business as Penguin Group…….”

In the immortal words of “Anchorman” Ron Burgundy, Harry Potter is “kind of a big deal.” No word on whether or not, like Burgundy, the wizard has many leather-bound books and his apartment smells of rich mahogany, but one thing is for sure—Harry Potter is plastered all over the Most Downloaded eBook and audiobook lists for March. All that, and the J.K. Rowling titles were only available for three days!

The Hogwarts hero has made a grand entrance to Juvenile Fiction lists worldwide. In the U.K., the HP eBooks occupy positions 2-8; the first five audiobooks in the series hold 5-9. Other titles popular in the U.K. that you may have missed include the Adult Nonfiction audiobook The Knave of Spades and the Adult Fiction audiobook Brother and Sister by Joanna Trollope.

Flying eastward on his broomstick, Harry Potter made a bold landing in Australia. The series occuppied spots 4, 6, 7, 8 and 9 on Australia’s most-downloaded Juvenile Fiction audiobooks and claimed spots 4-8 and 10 on the corresponding eBook list. Harry may have to fight Katniss Everdeen for the top spots Down Under, however, as Suzanne Collins’ Hunger Games series held the top three spots on both the eBook and audiobook Juvenile Fiction lists. Some other eBooks to watch out for in Australia are Michael Connelly’s The Black Echo, which debuted at No. 5 on the Adult Fiction list, and Lone Wolf by Jodi Picoult.

Harry Potter burst onto the scene in North America, too, soaring to No. 3 on the U.S. Juvenile Fiction eBook list and No. 4 on the Canadian Juvenile Fiction audiobook list. The title of Sophie Kinsella’s novel I’ve Got Your Number rang true again, as the cell-phone romance topped Canada’s most-downloaded Adult Fiction audiobook list and placed third on the corresponding eBook list. In the U.S., William Landay’s Defending Jacob is gathering steam; it was the fourth most downloaded Adult Fiction eBook and audiobook.

It’s clear that, for library patrons, the more Potter, the better. At least for March. I have a feeling the magic will only grow in April.

Many of you are experiencing problems with downloading books to your Kindle from both of our OverDrive eBooks / eAudio books websites. You’re not alone in your frustrations. Publishers are (in my opinion) panicking from the phenomenal sales of ereader devices and the rise in the usage of ebooks from Public Libraries. Publishers have responded in many ways: Harper Collins restricted number of uses (26) at which point you have to repurchase; Random House raised the cost of ebooks by about 300%; Macmillan, Simon and Schuster, Brilliance and Hachette withdrew from their contracts and will no longer sell ebooks to any vender other than Apple. In all cases we were allowed to keep the titles already purchased, we just can’t buy new titles. Penguin Publishing Group withdrew their contracts and will no longer sell ebooks to anyone other than Apple plus said that they would not allow their books to be transferred over the air by Whispersync. All Penguin titles must be download via USB cord. So what does this mean? As long as you have a Kindle device (Fire, Touch, etc) you can download Penguin titles to your device using your USB cord, but, if you own a device that uses a Kindle App, you can’t get a Penguin title at all. Devices using Kindle App’s are: iPads, Smartphones, tablets (Android based) and many others.

So, how do you know that the title you are downloading is a Penguin title, because not all Kindle formated books have these restrictions. Here’s what to watch for. Kindle formatted books from other puplishers will say: “Use on: Kindles and free Kindle apps”, Kindle formatted books from Penguin will say: “Use on: Kindle devices via USB only”. Please know that OverDrive is working to add other Publishers to compensate for the loss of those publishers listed above, and we area libraries are as frustrated as you at the complications and loss presented by these publishers. If you have any questions please call the adult information desks at (269) 329-4542 ext 600 or email us at Answerline@portagelibrary.info.

The Portage District Library offers you multiple ways to borrow free e-Books for your reading devices. We offer books through our collaboration with 24 other libraries at our MCLS database (Midwest Collaborative for Library Services http://ebooks.mlcnet.org/) powered by OverDrive. The primary focus of the Consortium’s database is the New York Times best sellers and the hottest adult and young adult authors. We currently (because of budget constraints) do not do back list titles or B-string authors.

We offer a smaller database from the same company called OverDrive PDL, (http://pdl.lib.overdrive.com/). Our primary focus is on popular authors that our patrons are reading. We welcome suggestions for authors and titles and most suggestions will be purchased for the collection.
Also, (for PC only and not reading devices) we offer a source for kid’s picture and beginning chapter books called Tumblebooks (http://portagelibrary.info/parents-kids/tumblebooks/). This is a canned collection and we cannot add or modify the selection.

All of these resources can be accessed from our website at http://www.portagelibrary.info in the “Books and More” section. (http://www.portagelibrary.info/books-and-more/ereaders/).

Starting March 5, 2012 the Portage District library will be offering weekly drop-in sessions to help you get started with or troubleshoot problems with OverDrive and your reading device. Contact the library for more information on these Drop-in sessions.

During March the sessions will be held at 10am-12pm March 5; 2pm-4pm March12; 6pm-8pm March 19; and 2pm-4pm March 26.

Suzanne Collins’ “The Hunger Games” trilogy occupied the top three spots in lists of Most Downloaded Juvenile Fiction Audiobooks for the United States, Canada and Australia.

I’m going to do my best prognosticating in a moment, but first let me hit a few mainstays. Holding steady over the past two months were “The Hunger Games” trilogy and “War Horse,” both of which pulled off the rare feat of occupying space in all four Most Downloaded lists! The Games have entrapped the top three spots in each Juvenile Fiction Audiobook list except the U.K., where they hold spaces two through four. Holding the No. 1 spot? You guessed it: “War Horse.” Michael Morpurgo’s World War 1 adventure had another good month; it was the No. 4 Audiobook in the U.S., Canada and Australia.

Surprisingly, these two titles weren’t the only ones to make all four international download lists. “Three Cups of Tea” by Greg Mortenson is five years old and just making its debut onto the Most Downloaded list, but it is doing so with four lumps of sugar, so to speak. The juvenile nonfiction Audiobook title is No. 3 in the U.K., No. 2 in both Canada and the U.S., and all the way up at No. 1 in Australia.

A couple of new eBook titles sheepishly snuck their way into Canada last month, and I expect they’ll make some more noise around the lists moving forward. Susan Cain’s “Quiet” and Katherine Boo’s “Behind the Beautiful Forevers” both hit the Canadian Adult Nonfiction eBook list last month, coming in at Nos. 6 and 7, respectively. Cain also made the U.S. list, where “Quiet” currently ranks No. 9.
Sophie Kinsella’s “I’ve Got Your Number” also debuted last month, and while she’s only on one list (Adult Fiction Audiobooks), she exploded onto that scene at No. 1. Since I went out on a bit of a limb with my previous forecast, I’ll go ahead and bring Sophie with me. She’ll be an even hotter commodity next month.

As we transition into the second quarter, more content excitement should shift our lists in a display of worldwide wizardry, and just in the nick of time. I don’t have any crystal, but when I asked my Magic 8 Ball if I could expect exciting developments, I got a very telling answer: “It is decidedly so.” We’ll see whose predictions are more accurate when the numbers come out for March.

Yes your library cards do expire and we had an enormous amount of cards expire on March 1, 2012. Our current catalog system is set up to renew cards each year. Often you are not even aware that your card has been renewed because at the checkout desk, the clerks seem to do it so easily without our being aware that it happened. Now so many of us are using our cards more and more online and less in the library. Our current system does not recognize online use only in house use, and more and more of us are experiencing that “Privilege Has Expired” when we try to place a hold or download a book. When you receive that message, please stop by the library with your driver’s license and renew your card.

As you may have heard in recent news, Random House, Inc. will be raising its eBook prices on March 1, 2012. OverDrive had several meetings with the Random House library team and they expressed their ongoing appreciation of the strong support libraries provide for their titles and authors. Random House is providing all new eBook releases to the library simultaneously with those in print/retail. On March 1, 2012 Random House did raise their prices by 300%. This astronomical price raise put the cost of digital books at or above the cost of a hard copy.

With the launch of PlayBook OS 2.0, OverDrive Media Console now allows users to access digital titles on their BlackBerry tablets. The OMC app for PlayBook has the same great functionality seen on other platforms, allowing you to check out and download titles right from your device. All you have to do is make sure you install the most up-to-date firmware on your PlayBook, search for ‘OverDrive’ in App World then install the app. You’ll be listening to audiobooks or reading eBooks in no time.

PlayBook OS 2.0 makes the BlackBerry tablet even more appealing than it was before. If you’re currently in the market for such a device, but are on the fence, the PlayBook is a solid choice. Priced around $200 to $250, this 7-inch tablet offers more features than much of its similarly priced competition. You get dual cameras (front and back), 16GB (or more) of storage and a beautiful screen. It even comes with a neoprene sleeve!

Welcome to the family, PlayBook!

For Kindle titles on OverDrive, there are currently two possible methods for acquiring titles. The following messages are displayed in the descriptions of the titles on OverDrive.

The first message says “Use on: Kindles and free Kindle apps”. This means that the title can be downloaded wirelessly to your Kindle device or Kindle app on your Apple or Android device. An alternative method is that it can be downloaded and transferred via USB to a Kindle device only.

The second message says “Use on: Kindles and free Kindle apps via USB only“.
This is an incorrect statement as they can only be downloaded and transfered to a Kindle device, not an app on your Apple of Android device. This is an incorrect statement as your can only use your USB cord to download to a Kindle bu not a Kindle app. They are working to change the message to something like “Use on: Kindle devices via USB only.”
